10 Documents To Request When Preparing A Defense (Blood Test)

1. Complete written procedures for analysis of blood samples for alcohol content for the method used to analyze the defendant's blood in this case.

2. Complete written procedures for calibration and qualify control of equipment and methods used to analyze the defendant's blood in this case.

3. Any writing or other record (such as, but not limited to, resume or curriculum vitae) showing the qualifications (including the Professional experience, training, education and license status) of (Anyone who was connected with defendant's blood test or who may be called to testify as an expert).

4. Any writing or other record showing the identity, including make, model and serial number, of all equipment and instruments used in this case to test the defendant's blood for alcohol content.

5. Any writing or other record showing the identity, including make, model and serial number, of any equipment used to calibrate items identified in item 4, for any calibrations during the period beginning 6 months before the test of defendant's blood, and ending 1 month after.

6. Maintenance log, operator's log, quality control log and calibrations log, or records of any kind related to maintenance, operation, quality control or calibration, for all equipment identified in item 4 or 5, and for all solutions used for the purpose of calibration or quality control, for the period beginning 6 months before the test of defendant's blood, and ending 1 month after.

7. All writings or records of all tests of the defendant's blood in this case.

8. The license of the laboratory where the defendant's blood was tested, for the year of arrest.

9. Any written or otherwise recorded reports or communications from or to the laboratory where defendant's blood was tested, during the 2 year period preceding the test of defendant's blood, which concern on-site inspections by the California Department of Health, or the laboratory's analysis of periodic evaluation samples submitted by the California Department of Health. (Cal. C. off Regs., Title 17, ss 1222, 1216.1(a) (4), 1217.5)

10. Any writings related to the testing by the laboratory of evaluation samples submitted by the National Highway Traffic Safety Administration in the program known as the "Blood Test Program".
